The Oregon Department of Education, Early Learning Division is excited to announce a permanent opening for a Legal & Enforcement Director (Compliance & Regulatory Manager 2). The Early Learning Division is in the process of becoming the Department of Early Learning and Care, a new agency that will elevate the State’s focus on birth-five programs and child care across Oregon. This position will play a critical role in the development of the Early Learning Division as its own state agency.

This position will start off fully remote with the possibility of a hybrid schedule of working both remotely and in the office in the future.

This position is part of the Early Learning Division – a Division that prides itself on enabling Oregon's young children and families to learn and thrive. The Division is responsible for overseeing the state’s Head Start, Pre-Kindergarten, and Relief Nurseries programs, among others; and licensing Oregon’s child care providers. What you will do:

As the Legal and Enforcement Director (LED), you will supervise a staff of enforcement personnel that may include enforcement officers, investigators, compliance specialists, and support staff who investigate and take enforcement actions related to violations or non-compliance of the Oregon Child Care provider laws and administrative rules.

You will manage the daily operations of OCC’s Legal and Enforcement unit, make policy recommendations and advise the Director(s) on enforcement policy and investigatory matters. You will also act as the liaison with the Department of Justice, with respect to enforcement and compliance actions, to coordinate and ensure legal actions meet the Oregon Administrative

Procedures Act (APA) and requirements of law and due process while prioritizing the safety of children in child care. You will provide regulatory advice to the licensing, compliance and enforcement staff of the Office of Child Care (OCC) and oversight of all enforcement functions, and also work with regional managers, licensing managers and compliance leads to ensure that decisions are timely and consistent across the state and meet the goals of protecting children and guiding providers.

 What we are looking for:

Six years of supervision, management, or progressively related experience; OR three years of related experience and a Bachelor’s degree in a related field.

In addition, we are looking for applicants that have the following Desired Attributes:

  • 5 years of legal background including expertise in administrative law
  • Preference may be given to candidates with a juris doctorate degree, membership in a state bar association, and or experience as a prosecutor or other criminal trial experience
  • Experience and/or knowledge of early learning policy
  • Experience and/or knowledge of state legislative process
  • Experience and/or knowledge of rule-making process
  • Experience and/or knowledge of statewide budget process, policy and practices
  • Experience and/or knowledge of policy analysis and decision making
  • Experience and/or knowledge of federal legislative process
  • The ability to apply an equity lens to all decisions
