Position Timeline: June 2024 - November 2024

Application posted: May 24th, 2024

The Freedom for All Coloradans Campaign:

Freedom for All Coloradans is made up of coalition members and leaders in the LGBTQ+ community, and our allies, who are committed to protecting the Freedom to Marry in Colorado and opposing any anti-LGBTQ+ initiatives that are put forth by conservative activists in Colorado. The work in 2024 is focused on two main initiatives:

  • A referred measure that is on the ballot in 2024 to repeal Amendment 43, the constitutional ban Colorado has on same-sex marriage that reads, “Shall there be an amendment to the Colorado constitution to remove the ban on same sex marriage?
  • Opposing any of the anti-LGBTQ+ initiatives that conservative activists have put forth. Proponents are collecting signatures right now and we are laying the foundation to oppose them if they make the ballot.

About Amendment 43:

Colorado is one of 30 states that currently has a statewide ban on same-sex marriage in the constitution. Colorado voters narrowly passed Amendment 43 in 2006, defining marriage as between one man and one woman.

Currently, the 2015 U.S. Supreme Court’s decision in Obergefell v. Hodges protects the freedom to marry, superseding Colorado’s Amendment 43. However, if Obergefell is overturned, same-sex marriage would no longer be legal in the State of Colorado. The 2022 federal Respect for Marriage Act would protect the some 7,000 LGBTQ+ Coloradans who are currently married. Without Obergefell or new federal protections, LGBTQ+ Coloradans would not be allowed to marry and they  would lose access to the many benefits marriage equality grants.

We cannot rest on the assumption that Obergefell is assured. We need to take action to #RemoveTheBan - Amendment 43  - and protect the freedom to marry in Colorado.

About our Opposition Efforts:

Beginning in January 2024, conservative activists under the umbrellas of Protect Kids CO, Gays Against Groomers and the Colorado Republican Party, submitted 30 ballot initiatives through the Title Board process aimed at limiting the rights of LGBTQ+ youth and families in Colorado. These initiatives consisted of a ban on gender affirming care for minors, preventing trans girls from playing in school sports, and various versions of “parental rights'' that include enshrining parental rights in the state constitution, forcing teachers to out LGBTQ+ youth, decreasing youth access to healthcare, and censoring teachers and school personnel.

Leaders in the LGBTQ+ community including One Colorado and Out Boulder County, through the To Protect LGBTQ+ Coloradans issue committee, have diligently opposed the initiatives through the Title Board, bringing the number of active initiatives down to three. The coalition is committed to the continued work required to ensure these ballot initiatives don’t make the ballot or become law.
