Our Mission: Our Children’s Trust is a non-profit public interest law firm that provides strategic, campaign-based legal services to youth from diverse backgrounds to secure their legal rights to a safe climate. We work to protect the Earth’s climate system for present and future generations by representing young people in global legal efforts to secure their binding and enforceable legal rights to a healthy atmosphere and stable climate, based on the best available science. We support our youth clients and amplify their voices before the third branch of government in a highly strategic legal campaign that includes targeted media, education, and public engagement work to support the youths’ legal actions. Our legal work – guided by constitutional, public trust, human rights laws and the laws of nature – aims to ensure systemic and science-based climate recovery planning and remedies at federal, state, and global levels. We seek legally-binding, countrywide and/or statewide science-based Climate Recovery Plans that will return atmospheric carbon dioxide concentrations to levels below 350 ppm by the year 2100.

Position Summary: This position will help advance OCT’s strategic legal campaign to protect youths constitutional right to a safe climate. The staff attorney will assist senior staff attorneys, develop new legal actions, and assist outside counsel on all facets of the youth-led, science-based climate recovery legal actions consistent with OCT’s strategy. They will also assist in directing and mentoring paralegals and law clerks.

Key Responsibilities:

  • Assist senior attorneys in representing youth clients in ongoing legal actions pursuant to OCT legal strategy in state, federal, and foreign jurisdictions.
  • Develop and help advance new legal actions, as directed by Executive Director/Chief Legal Counsel, Senior Litigation Attorney, or Managing Attorney, including developing jurisdiction-specific legal strategy consistent with OCT’s overall legal strategy.
  • Assist senior attorneys in supporting outside local counsel and youth clients in assigned jurisdictions on all facets of the youth-led, science-based climate recovery legal actions pending or in development there to ensure consistency with OCT legal strategy.
  • Support the work of senior attorneys and local counsel on legal actions as assigned, including: client management, local counsel outreach, legal strategy, legal research, legal drafting, legal editing, factual research and case development, expert and amici development and support, case management and advancement, document review and summary, coordination, etc.;
  • Ensure all communications, education, and engagement work in support of assigned cases are consistent with and enhance the legal strategy by working in coordination with senior attorneys and the Director of Communications, Education and Engagement.

Additional Responsibilities

  • Ensure strong, timely, and continual progress on all cases assigned.
  • Provide direction to paralegals working on assigned legal actions.
  • Provide direction and mentorship support of law clerks and law fellows, as needed
  • Draft advice and memoranda for both OCT staff and partners on complex legal and scientific issues as requested;
  • As requested, serve as counsel of record in cases alongside a senior OCT attorney, or outside lead counsel of record.

  • JD and active license to practice law in the jurisdiction in which Staff Attorney resides.
  • 1-4 years of litigation experience in state or federal courts.
  • Demonstrated commitment to legal excellence.
  • Demonstrated commitment to strategic litigation.
  • Exceptional legal advocacy, organizational and communications skills.
  • Strong interpersonal skills.

Preferred Qualifications:

  • Experience with constitutional, human rights, or civil rights litigation.
  • Experience working with youth clients.
  • Understanding of legislative processes and advocacy.
  • Foreign language skills.
  • Prior work with non-profit advocacy organizations.

Salary and Benefits: Salary range: $60,240 - $67,239. Benefits include 100% employer paid medical and dental for employee, long and short term disability, life insurance, SIMPLE IRA plan, generous vacation, sick and holiday leave including restorative leave after 6 years. This position is part of the OCTWA Bargaining Unit.

Working Conditions/Work Schedule: Work is primarily performed in a standard office setting. Work is primarily performed Monday through Friday; however, evening and weekend hours may be necessary dependent upon deadlines and workload.

This position requires the incumbent to sit for long periods of time; understand speech of another person and speak clearly so listeners can understand; routinely uses fingers to grasp, type move or assemble small objects. Position occasionally lifts and carries files and boxes weighing up to 20 pounds.
