KIND was founded by the Microsoft Corporation and UNHCR Special Envoy Angelina Jolie, and is the leading national organization that works to ensure that no refugee or immigrant child faces immigration court alone. We do this in partnership with over 531 law firms, corporate legal departments, law schools, and bar associations has served more than 16,386 children since 2009, and trained over 26,018 private sector attorneys to provide them with high quality representation in their deportation proceedings. KIND promotes protection of children in countries of origin and transit countries and works to address the root causes of child migration from Central America. KIND also advocates to change law, policy, and practices to improve the protection of unaccompanied children in the United States, by educating policymakers, the media, and the broader public about the violence that is driving children out of Central America and their need for protection. 

POSITION DESCRIPTION 

KIND seeks three Senior Attorney to be located in the following locations: 1) the mid-Atlantic or Northeast U.S. (to be based in KIND’s offices at one of the following locations: Boston, New York, New Jersey, or Washington, D.C.); 2) one Senior Attorney to be based in KIND’s Houston office, and 3) one Senior Attorney to be based in KIND’s Los Angeles office.

The Senior Attorneys will help develop, maintain, and oversee the provision of free legal representation to unaccompanied children by KIND staff and through its network of major law firms, corporate partners, and law schools. The Senior Attorneys may also provide mentoring and support to pro bono attorneys handling the cases of separated parents and families as needed. The Senior Attorneys will report to the Deputy Director of Legal Services and will have a variety of responsibilities, including but not limited to:

  • Provide direct representation to children affected by the zero tolerance and family separation policy;
  • Provide mentoring to pro bono attorneys handling the cases of separated children and families as needed;
  • Develop and present training and guidance materials on emergent legal issues affecting unaccompanied and separated children and their families for use by KIND staff, pro bono attorneys, and partner service providers;
  •  Ensure dissemination of timely guidance and case assistance in rapidly changing legal and political landscape, including in the family separation crisis;
  •  Provide advanced trainings on asylum law, Special Immigrant Juvenile Status, T visas, recent Executive Orders and Attorney General rulings affecting unaccompanied children, and other cutting-edge topics, and assist KIND field staff in developing jurisdiction-specific guidance; 
  • Triage referrals for children needing legal services, including referrals for children in ORR or ICE detention facilities and upon release, and facilitate representation;
  • Where needed, provide or oversee KYRs, legal orientations, credible fear interview preparation, communication and/or contact and reunification efforts for separated parents and families;
  • Work closely with KIND staff and colleague organizations to ensure streamlined services to separated children, including locating a separated parent and handling of unforeseen scenarios, such as the rapid movement of separated children and adults between facilities, released locations, and/or removal;
  • Provide hands-on mentorship to KIND legal staff, equipping them to work effectively in providing direct representation or advising pro bono attorneys;
  •  Assist in funding deliverables oversight, process mapping, and tracking data and outcomes;
  • In consultation with the Director of Pro Bono Partnerships, support law firms and corporations providing individual case, appellate, and/or amicus work on behalf of separated and unaccompanied children;
  • Facilitate referrals to KIND field offices for children released into a KIND jurisdiction, and coordinate continuing representation for separated children who are released outside of KIND’s service area where practicable;
  • Facilitate cross-referrals with social services, mental health and medical providers;
  • Participate in coalitions to stay abreast of legal developments and trends to inform mentoring of pro bono attorneys, and to ensure rapid dissemination of KIND guidance materials to other providers to benefit separated and unaccompanied children and their families;
  • Support LST Management and Deputy Director with project management tasks, including reporting, and funder and media relations.

REQUIRED SKILLS 

  •  Member of the bar, preferably in the applicable jurisdiction in which you seek to be located;
  •  At least 5 to 7 years of experience practicing immigration law, which should include representation of clients in humanitarian immigration claims such as asylum, Special Immigrant Juvenile Status, U visas and T visa;
  •  Experience working with children, preferably immigrant and refugee children, or experience working with survivors of abuse, human trafficking, or other trauma;
  •  Experience working with detained immigrants;
  •  A strong record of cultural competence and cross-cultural communication skills;
  •  Mentoring and training experience;
  •  Excellent oral and written communication skills;
  •  Excellent professional judgment;
  •  Ability to hit the ground working, multi-task, and work independently;
  •  Ability to work collaboratively;
  •  Spanish fluency strongly preferred; and
  •  Occasional travel.
