Position: Temporary Six-Month Contract Attorney 

Reports to: Senior Counsel 

Contract Date: April 1, 2021 – October 1, 2021 

Hours and Location: This is a full-time temporary employment position during regular business hours, based in San Francisco, with some flexibility in schedule. With the current health crisis, Equal Rights Advocates will ask the contract attorney to work out-of-office so long as health mandates recommend it. After that, work will be performed at ERA’s San Francisco office; it will require infrequent out-of-office travel and occasionally can be performed remotely. 

Compensation: The six-month temporary staff attorney will be paid $32,500-$34,000, depending on experience, ERA also offers generous health benefits, paid sick time, and other benefits required by law 

The Opportunity: 

Equal Rights Advocates (ERA) seeks a dynamic and motivated attorney with 2-5 years of relevant experience to temporarily provide direct legal services and supervise the same through our Legal Advice & Counseling (A&C) Program, which provides legal information, brief services, limited representation, and other advocacy to workers and students across the country on matters involving gender discrimination, unfair pay, sexual harassment/violence, and related civil rights issues. 

In addition, this attorney will provide whatever support is needed to the senior litigation attorney and the Legal Director on all aspects of litigation, including fact development, legal research, drafting pleadings, discovery, motion practice, mediation, trial, and settlement implementation/ monitoring. Additionally, this attorney may engage in limited outreach and policy advocacy as needed. 

The Organization: 

Equal Rights Advocates (ERA) is a national civil rights organization founded in 1974 to expand economic and educational access and opportunities for women and girls. ERA embraces an inclusive and intersectional view of gender justice, inclusive of non-binary and gender non-conforming people. As we combat the patriarchy, we also challenge racist power structures and inequities compounded by ethnicity, class, sexual orientation, age, and other identities.  

Our talented and fierce team includes litigators, policy reformers, and movement builders working at the state, multi-state and national level promoting gender equity and racial justice, expanding economic security, and growing community power. ERA’s legal initiatives include the Initiative to End Sexual Violence in Education (including a pro bono network of volunteer attorneys), and several campaigns chaired by ERA and led in partnership with 70+ partner organizations across the country driving gender justice reform and enforcement. These include the Equal Pay Today campaign, the Women’s Agenda Initiative, the Network of States to Stop Harassment, and the Stronger California Women’s Economic Security Campaign.  

ERA has a total of 20 staff members, including one located in Washington D.C. ERA’s annual operating budget is $3.5 million, with significant growth prioritized in 2021. 

Responsibilities:  

General responsibilities will include, but are not limited to:  

Advice and Counseling Program (65%) 

  • Conduct intakes and provide legal information, advice, and other legal assistance to individuals on issues related to gender discrimination in employment and train and supervise volunteer law clerks providing the same; 
  • Manage a small but growing case load (5-10) of prelitigation employment cases, including filing charges with the EEOC or other enforcement agencies; 
  • Coordinate and supervise day-to-day operations of ERA’s Advice & Counseling (A&C) program, audit compliance with internal protocols, develop as needed client-facing materials, and provide information to Development and Communications departments as needed; 
  • Identify trends and potential impact cases and report those to the senior litigation and policy attorneys. 

Litigation (30%) 

  • Support the senior litigation attorney with all aspects of education and employment discrimination cases, including but not limited to fact development, client communications, legal research, drafting pleadings, motions, and correspondence, discovery, and preparing for and attending mediation or court hearings; 
  • Provide technical assistance and guidance to outside attorneys bringing Title IX cases pursuant to existing consulting agreements or as requested; 
  • Take primary responsibility for carrying forward settlement implementation and monitoring tasks in two education cases, including facilitating monthly meetings, reviewing and providing input on anti-discrimination policies, climate surveys, and training materials, providing other guidance as requested, and helping to draft new policies if/when new Title IX regulations are issued; and 
  • Contribute ideas and thought leadership to strategic case discussions. 

Community Outreach and Policy Advocacy (5%) 

  • Provide additional support as needed to our senior policy attorney on developing bills, advocacy events, or legislative hearings; 
  • Provide additional support and input as needed to our outreach team, including partnering with other team members to plan and execute (virtual) community legal outreach, education, and trainings. 

Required Qualifications:  

  • Active license to practice law in California; 
  • Minimum of two years’ experience providing direct legal services to individuals in need (experience in matters related to workplace justice, economic security, education-related civil rights, and/or combating sexual or gender-based violence strongly preferred); 
  • Minimum of one year’s experience in civil litigation; 
  • Demonstrated Commitment to, and passion for, social justice and gender equity 
  • Strong organizational and time management skills with ability to prioritize competing deadlines and take direction from more than one manager; 
  • Excellent verbal and written communication skills and interest in significant client interaction; 
  • Demonstrated ability to work independently, take initiative, exercise good judgment, and follow through/follow up; 
  • Ability to use and manage communications across various channels, computer programs, systems, applications, databases, and case management platforms, including Microsoft Office Suite, and the ability to use or quickly learn Google Suite, Slack, Basecamp, Clio, and LegalServer. 

Preferred Qualifications: 

  • Direct experience in gender discrimination in employment and education; 
  • Experience advocating for, representing, and/or collaborating with low-wage workers, women and girls of color, immigrants, and/or individuals who identify as LGBTQIA+; 
  • Experience working directly with victims of sexual trauma and/or gender-based violence or other familiarity with the effects of trauma and the importance of trauma-informed services; 
  • Proficiency in written and spoken Spanish.
