Managing Immigration Attorney

The Multicultural Center (MC) at NVFS provides multicultural mental health, case management and legal services that address the needs of low-income, English-limited immigrants and refugees for whom existing services are inaccessible due to language and cultural barriers. Clients include individuals from all cultural and ethnic groups whose mental health and socio-economic stability is compromised as a result of trauma, poverty, chronic stress, and other tremendous challenges posed by the process of cultural adjustment. Trauma informed services are provided by bilingual, bicultural counselors, therapists, case managers and attorneys/ accredited representatives.

The Managing Immigration Attorney functions as the immigration legal expert on the Multicultural Center Management Team. This role is responsible for the daily operations of the Immigration Legal Services program including planning, organization, implementation, documentation and coordination of legal services delivery. The Managing Immigration Attorney exercises independent judgment and decision-making authority, including around policies, procedures, and staff supervision. This role is responsible for ensuring compliance with all ethical and professional rules, as well as providing quality control for the program as a whole. The Managing Immigration Attorney also represents low income, culturally diverse clients in humanitarian and family-based immigration cases. This position is part of the Multicultural Center leadership team and has a starting salary of $70,000. In light of the COVID-19 pandemic, this position will be working remotely while providing some essential services which may require occasional in-person and/or in-office work.

 Program Management:

  • Work collaboratively with the Multicultural Center leadership team to envision and implement holistic services for clients, as well as efficient internal and cross-program work flows.
  • Ensure that service delivery is of high quality and performed according to the NVFS mission, all external regulatory standards and relevant professional codes of ethics.
  • Stay abreast of changing immigration policies and adapt the program as necessary and in response to evolving community needs.
  • Prepare narrative and statistical reports to the Agency and contract monitors measuring program effectiveness.
  • Assist the Program Director in formulating the annual program budget and expend funds appropriately. Ensure that the program operates within budgetary parameters established. Ensure that program service fees are collected and processed correctly.
  • Provide support and expertise to the Development team as they seek grant and contract funding and launch fundraising campaigns around immigration and/or legal issues. 
  • Keep MC leadership and staff apprised of changes in immigration law and policy and their effect on MC clients.
  • Provide feedback about how agency-wide systems and policies can be implemented within the program.
  • Provide limited community outreach and training as time permits. 

Staff Supervision and Development:

  • Build and maintain a strong functional team through effective recruiting, training, and supervision of staff.
  • Identify and fulfill staffing needs; work collaboratively with each staff member on talent development process to set job and development goals; approve timesheets, leave and reimbursement requests.
  • Provide ongoing staff training and/or identify and facilitate outside training opportunities.
  • Supervise program staff including conducting regular individual and group staff meetings and case consultation; ensure proper client to staff ratio and monitor case files for quality and completeness.
  • Monitor staff caseloads to ensure an appropriate workload as well as alignment with funder output requirements.
  • Oversee the legal internship program including recruiting, interviewing, and supervising legal interns and collaborating with NVFS Volunteer Coordinators. 

 Direct Services:

  • Carry a 50% caseload of direct client services.
  • Conduct initial phone intake and legal consultation to determine eligibility for program services.
  • Prepare and submit immigration applications for the following:
  • Asylum, withholding of removal, Convention Against Torture claims
  • VAWA petitions, removal of condition waivers, and cancellation of removal
  • U visas
  • T visas
  • Special Immigrant Juvenile Status
  • Naturalization
  • Adjustment of status
  • Family petitions
  • Consular processing
  • Temporary Protected Status/Deferred Enforced Departure
  • DACA
  • Waivers of inadmissibility
  • Additional benefits such as employment authorization documents, travel documents, renewal of permanent resident cards, Certificates of Citizenship, FOIAs , etc.
  • Other types of immigration cases as necessary.
  • Represent clients before U.S. Citizenship and Immigration Services, the Executive Office for Immigration Review, the Board of Immigration Appeals, and the U.S. Department of State; including attending immigration interviews, asylum interviews, immigration court hearings, and Infopass appointments.
  • Perform administrative duties necessary to support legal representation (copying, filing, translating, etc.).
  • Ensure client fees are assessed and collected per retainer agreements.
  • Maintain client database and files in accordance with program/legal requirements and NVFS guidelines.
  • Comply with all legal ethical standards.
  • Make internal and external referrals to other services within the Agency and community, and work with other NVFS staff to provide collaborative services to clients.
  • Keep informed of changing immigration laws and procedures.
  • Conduct outreach, lead trainings and participate in networking activities to promote services and to learn about available resources; collaborate with other agencies to complement services.
  • Maintain bar membership through continuing education.

Qualification and Additional Requirements: An individual may obtain skills through a variety of professional, personal, educational, and volunteer experiences. The requirements listed below are representative of the knowledge, skills, and/or abilities required to perform essential job duties.  

  • JD required; must be a member of good standing in any state or the District of Columbia (Virginia preferred) and maintain bar membership through continuing education
  • At least three (3) years of experience practicing immigration law required; must include experience with complex humanitarian and/or removal defense
  • Must have experience working with survivors of trauma
  • Passion for providing nonprofit legal services and serving vulnerable populations
  • Oral and written fluency in English required; fluency in client languages (including but not limited to Spanish, Arabic, French, Farsi) a plus
  • Demonstrated program management and staff supervision experience required
  • Proficiency in usage of basic technological tools including laptops/computers, email, phones, and internet required. Working knowledge of Microsoft Office Suite and video meeting platforms required.
  • Must be able to demonstrate and live the organizational values of Communication, Integrity, Respect, Collaboration, and Accountability.
  • May be called upon to work beyond normal working hours; required to follow court schedules and attend in-person court dates as needed. 
  • Must be willing and able to travel to various locations within Northern Virginia and Maryland
  • Successful completion of background checks required upon hire
