Al Otro Lado is a binational legal services organization serving refugees and deportees in Tijuana, Mexico San Diego and Los Angeles, California. . Al Otro Lado’s Litigation Program challenges policies and practices that violate the rights of migrants. Al Otro Lado is an organizational plaintiff or counsel in seven separate class action lawsuits challenging anti-asylum policies, slave labor practices in immigration prisons, and dangerously substandard care for detained disabled and medically vulnerable migrants. The Litigation Program also files individual habeas claims for migrants whose rights are violated in detention and at the border. 

Current litigation includes Al Otro Lado v. Wolf (challenging the policy of “metering”), East Bay Sanctuary v. Trump (challenging Asylum Ban 1.0), Innovation Law Lab v. Wolf (challenging the Remain in México policy), East Bay Sanctuary v. Barr (challenging Asylum Ban 2.0, i.e. the “Transit Rule”), Al Otro Lado v. DHS (Freedom of Information Act lawsuit), Southern Poverty Law Center v. DHS (Freedom of Information Act lawsuit), Fraihat v. ICE (challenging ICE’s failure to provide medical care or adequate disabilities accommodations for detained immigrants), Novoa v. GEO Group (challenging forced labor practices of private prison corporation), and Gonzalez v. Core Civic (challenging forced labor practices of private prison corporation)

The Staff Attorney will be engaged in litigation work and organization in both Tijuana, MX and San Diego. The position will be based in San Diego or Tijuana, MX, but may require frequent travel to Tijuana, MX.

This position will focus on assisting immigrants impacted by DHS border policies including the use of Title 42 expulsions, family separation, and the Migrant Protection Protocols (MPP) program, as well as detained immigrants. The position will involve federal litigation as well as advocacy before relevant administrative agencies and EOIR.

Duties include but are not limited to the following:

  • Engage in federal litigation work including class action litigation with partner organizations, FOIA litigation, and habeas representation directly and through pro bono attorneys to assist affected immigrants and groups and to impact changes in policy and the law;
  • Legal research and analysis for both litigation and non-litigation projects;
  • Coordinating and liaising with immigrants and affected individuals to gather testimony and other evidence relevant to their cases and to litigation;
  • FOIA request elaboration and filing;
  • Engage in advocacy before administrative agencies and before EOIR;
  • Appellate advocacy before administrative agencies and federal Courts of Appeals; 
  • Helping direct the work of interns and volunteer attorneys and non-attorneys;

This is a full-time, salaried exempt position. Competitive salary and benefits.

QUALIFICATIONS AND REQUIREMENTS

The applicant must be licensed to practice law in California and be eligible to be admitted to the Southern District of California. The applicant must have excellent research and writing skills, and oral advocacy skills. The applicant must also have 1-3 years of experience in federal civil litigation, including experience of federal court relief in immigration matters, as well as 1-3 years of experience in immigration law, specifically asylum. We will consider relevant federal judicial clerkship, EOIR clerkship or EOIR staff attorney, immigration paralegal experience, organizing experience, and/or law school clinic experience. Applicants should be self-directed and self-reliant, highly organized, flexible, and able to work in a high volume setting with limited resources. This position requires the ability to cross the United States-Mexico border on a regular basis. Spanish fluency is preferred, but all applicants will be considered.
