Purpose statement: This position will provide direct legal representation to low-income immigrants in Virginia in a variety of matters before the Executive Office for Immigration Review (EOIR), the US Citizenship and Immigration Service (USCIS), and Virginia state courts, with a focus on serving immigrant survivors of intimate partner violence, human trafficking, and vulnerable children and youth.

ORGANIZATIONAL PROFILE

Ayuda is a 501 (c)(3) nonprofit organization dedicated to providing direct legal, social, and language access services, education, and outreach to low-income immigrants in the Washington, DC metropolitan area. Since 1973, Ayuda has provided critical services on a wide range of issues, in the process acquiring nationally recognized expertise in several fields including immigration law, language access, domestic violence, and human trafficking. Ayuda has office locations in Washington, DC, Silver Spring, MD, and Fairfax, VA.

WHAT WILL THIS JOB ENTAIL?

  • Provide direct immigration legal representation in a variety of immigration matters before the Executive Office for Immigration Review (EOIR), the US Citizenship and Immigration Service (USCIS), and state courts with a focus on serving immigrant survivors of intimate partner violence, human trafficking, and vulnerable children and youth;
  • Provide legal representation to children either in ORR custody or formerly in ORR custody released to custodians in Northern Virginia, including representation in removal proceedings, state court custody matters in Virginia, and applications for other forms of relief before USCIS; 
  • Represent clients in administrative and judicial proceedings, including asylum-seekers; victims of trafficking seeking a T-visa; victims of crimes seeking a U-visa; victims of domestic violence seeking relief under VAWA; minors seeking Special Immigrant Juvenile Status; individuals seeking family unification through the family-based immigration process, and those seeking other forms of immigration relief and representation in immigration matters;
  • Attend and provide mentorship to volunteer attorneys at Ayuda’s pro bono immigration clinics; 
  • Mentor pro bono attorneys taking cases for long-term representation through Ayuda’s pro bono case pipeline; 
  • Stay current on relevant laws and policies by attending training and conferences and reviewing new laws, regulations and court rules; 
  • Represent Ayuda at meetings and collaborations with other agencies; 
  • Conduct training and community outreach on immigration issues; 
  • Collaborate with Ayuda’s social services staff to ensure the provision of holistic services;
  • Other duties as assigned.

Note that this job is primarily remote during the pandemic but typically requires travel to ORR facilities and courts in or near Richmond, VA, and throughout Northern Virginia. Ayuda reimburses such travel using the federally approved mileage rate.


Requirements

Eligibility: Must be legally able to work in the United States and maintain proper work authorization throughout employment. Must be able to meet the physical requirements of the position presented in a general office environment. 


HOW DO YOU KNOW IF YOU CAN DO THIS JOB?

Education/Experience/Skills:

  • Licensed to practice law or anticipated admission to practice law by December 1, 2021 (with licensure in Virginia strongly preferred). Individuals taking the July 2021 Virginia bar exam are encouraged to apply. Individuals who were admitted to any bar at least five years ago and have practiced law for three of the last five years may be eligible for admission to the Virginia bar without examination and are encouraged to apply.
  • This position is intended for an attorney with 0-3 years of relevant experience.
  • Bilingual Spanish language skills required;
  • Strong legal, organizational, and time-management skills;
  • Excellent oral and written communication skills; 
  • Ability to work independently and as part of a diverse, multidisciplinary team; 
  • Experience in immigration law, with litigation and removal defense experience a plus; 
  • Experience working with children and/or child custody or guardianship petitions a plus;
  • Experience working with survivors of trauma a plus; 
  • Availability to begin work as soon as possible (contingent on funder approval) preferred; and 
  • Demonstrated commitment to social, racial, and economic justice. 


SALARY AND BENEFITS:

The salary is commensurate with experience and begins at $52,500 for a law clerk, $54,000 for entry-level staff attorneys, and $60,000 for attorneys with one year of directly relevant experience providing immigration legal services to low-income individuals and comes with a robust benefits package that includes medical and dental insurance, long-term disability insurance, life, and AD&D insurance as well as an employer-provided retirement match. All federal holidays are observed, and Ayuda offers paid leave for the week of Christmas through New Year’s Day. This position is exempt for overtime purposes.
