Background

The International Treatment Preparedness Coalition (ITPC) is a global coalition of PLHIV and community activists working to achieve universal access to optimal HIV, HCV and TB treatment of those in need. Formed in 2003 by a group of 125 HIV activists from 65 countries at a meeting in Cape Town, ITPC actively advocates for treatment access in eight regions across the globe. ITPC believes that the fight for treatment remains one of the most significant global social justice issues.

The project Use of TRIPS Flexibilities to Increase Affordability of Treatment for HIV, Tuberculosis and Hepatitis C Virus in Middle-income Countries aims to address a critical gap in the global HIV response: access in some LMICs and in UMICs to newer, optimized antiretrovirals (ARVs) for preventing and treating HIV. Access to newer medicines that can cure tuberculosis (TB) and hepatitis C virus (HCV), two common, dangerous coinfections, among people living with HIV, is also necessary. Optimized ARVs are essential to reaching global HIV treatment targets, enacting the WHO ‘treat all’ recommendation and addressing the growing threat of resistance to non-nucleoside reverse transcriptase inhibitors (NNRTIs), which are widely used in first-line treatment. In light of ongoing COVID-19 pandemic ensuring affordability of potential COVID-19 treatments in middle-income countries is important component of global response.

The use of TRIPS flexibilities, as recommended by the UN High Level Panel on Access to Medicines,[1] will be necessary to improve access to optimized ARVs, TB medicines and DAAs in some LMICs and UMICs. The combined use of different flexibilities by multiple partners can act in synergy. Patent oppositions have proven to be an effective strategy to enable cost savings and put more people on treatment. During the past three years, ITPC, in partnership with the Brazilian Interdisciplinary AIDS Association (ABIA), FGEP, the All-Ukrainian Network (100% Life), and AIDS Access Foundation (AAF) has challenged thirteen patents on key ARVs. These patent oppositions led to cumulative estimated savings of US$472 million. 

ITPC Global together with robust civil society organizations working on improving access to medicines in India, Indonesia, Morocco, Thailand, Vietnam – AIDS Access Foundation (Thailand), Asia Pacific Network of People Living with HIV (APN+), ITPC-MENA (Morocco) – intends to build capacity of local young professionals or future professionals interested in IP issues and access to medicines to be able to prepare and launch patent oppositions in the field of pharmaceuticals. The Asian Patent Oppositions Academy (POA) will serve as an enabling instrument for young professionals in IP law or chemistry from Indonesia, Morocco, Vietnam and Thailand to increase their knowledge, improve their practical skills in developing and filing patent oppositions in the area of pharmaceuticals. Due to COVID-19 the Asian Patent Oppositions Academy shall be held online on online platform(s) provided by ITPC.


Consultant Scope of Work and Deliverables

ITPC is seeking consultant to (in collaboration with legal co-trainer):

·      Finalize development in online format of training materials (presentations, practical exercises, hand-outs, audio- or videorecordings, etc.) of Asian Patent Oppositions Academy in relation to scientific content from a global-level perspective (9 days);

·      Participate as a co-trainer for a 3 weeks Asian POA online training in 2021 (exact dates to be defined by ITPC later) (6 days).

Duration of Consultancy

·      1 December 2020 to 31 July 2021

Education & Experience Requirements

·    Minimum 5 years relevant experience in developing patent oppositions, providing scientific/pharmaceutical advice and/or conducting scientific analysis and drawing up reports, memorandums for nonprofit, philanthropic sector or related field for patent oppositions work is required;

·    Graduate degree in chemistry or pharmacy is required;

·    Fluency in English;

·    Experience and/or academic training in HIV/AIDS, public health, health policy, or related field is a plus;

·    Experience in collaboration with community-based organizations;

·    Participation as a trainer in previous POA(s) is a plus.

Compensation
