Description

Mobilization for Justice, Inc. (MFJ) (formerly MFY Legal Services, Inc.), a non-profit legal services organization that provides free civil legal services to low-income New Yorkers, is seeking an attorney for a one-year, temporary position to work on consumer and foreclosure cases. The attorney will be part of two projects that use a multi-prong approach to providing legal services and effecting reform in the consumer and foreclosure law areas. The attorney will be part of a team that represents homeowners in New York Supreme Court in Queens, Richmond and Kings Counties; prosecutes federal fair housing and other mortgage-related actions; and part of a team that represents consumers City-wide in debt collection cases, engages in advocacy, and initiates affirmative/impact litigation. Both teams work in coalition with advocacy groups on policy issues; provide testimony and comments on proposed legislation and regulations; conduct trainings for lawyers, housing counselors, and homeowners; and communicate regularly with elected officials and the media.



Responsibilities include, but are not limited to:

 

  • Conducting client intake; conducting legal research; drafting legal memoranda, advocacy letters and other legal papers; and litigating all phases of cases including defending consumer and foreclosure cases, handling settlement conferences in foreclosure cases, engaging in motion practice, conducting trials, writing and arguing appeals, filing complaints, and writing amicus briefs.
  • Identifying issues for impact or class action litigation or policy initiatives, including white papers and legislative advocacy campaigns;
  • Advocating in various forums on important consumer and foreclosure issues, including drafting testimony for public hearings;
  • Reaching out to the community and conducting trainings; and
  • Timely inputting and maintaining extensive records in a case management system.


Requirements:

  • Admission to NYS Bar.
  • Experience defending debt collection and foreclosure cases, and/or advising pro se litigants in debt collection cases, and/or experience with CLARO is preferred.
  • Experience negotiating different residential mortgage loan modifications and working with mortgage servicers is preferred.
  • Knowledge of consumer law areas, including foreclosure, student loans, debt collection, credit reporting, taxes, and/or bankruptcy is preferred.
  • Excellent research and writing skills.
  • Ability to balance working on complex litigation, handling individual casework, and advocating for legislative or policy changes.
  • Fluency in Spanish.
