Immigration Practice, Youth & Communities Project – Staff Attorney Position

Brooklyn Defender Services (BDS) is one of the largest public defense providers in the United States. We defend more than 35,000 indigent clients per year in New York City in criminal, family, and immigration proceedings. BDS’s clients have diverse, complex, and multi-faceted needs that must be addressed in a high-volume, fast-paced setting.

BDS’s Immigration Practice currently has a staff of around twenty-five attorneys, three BIA accredited representatives, three social workers, five paralegals, three administrative assistants, and three legal fellows. Our Immigration Unit’s “Padilla” team advises criminal defense colleagues and clients, helping to devise strategies to minimize the immigration impact of our clients’ criminal and family court cases. Additionally, the Padilla and Youth and Communities teams screen clients for relief and represent them in applications for citizenship, permanent residence, visas for domestic violence or trafficking victims, and other immigration benefits, as well as in non-detained removal proceedings, order of supervision appointments, and post-order motions. The New York Immigrant Family Unity Project (NYIFUP) team has been serving as assigned counsel under the first-in-the-nation program providing legal representation for indigent New Yorkers in detained removal proceedings at the Varick Street Immigration Court and in New Jersey.

Brief Description of the Position

We are seeking an experienced immigration attorney to join our Immigrant Youth and Communities Project. Our Youth and Communities team, an integral part of our broader Immigration Practice, provides a wide range of immigration legal services to young immigrant clients, non-citizen families, and other vulnerable individuals in Brooklyn and throughout NYC. Launched in 2012, our Immigrant Youth and Communities Project was designed to provide full representation to a greater number of BDS’s non-citizen clients identified through our NYIFUP, criminal, and family defense practices. BDS also serves the broader community through referrals from partner community-based organizations. The Staff Attorney will assist clients in pursuing affirmative immigration benefits, such as Special Immigrant Juvenile Status (SIJS) (including family court proceedings), family-based adjustment of status, naturalization/citizenship, and Temporary Protected Status (TPS), and other affirmative applications. Additionally, the Staff Attorney will defend clients that are placed in removal proceedings or that have an outstanding order of removal. The position includes some limited advocacy activities, including support and representation through community-based legal clinics, Know Your Rights presentations, committee work, and involvement in advocacy campaigns.

Qualifications:

We seek an experienced immigration attorney, preferably with experience in affirmative applications such as SIJS, naturalization, asylum, U/T visas, etc. Experience with removal proceedings is also a plus. Candidates must have a demonstrated commitment to immigrant rights, criminal justice, and social justice. The position requires enthusiasm, a strong ability to solve problems under time pressure, and the strongest commitment to clients. Preference will be given to candidates admitted in New York State, although attorneys admitted in other states willing to pursue NY admission, and recent law graduates with robust immigration experience, will also be considered.
