Actions Without Borders, Inc., and its affiliates (“Idealist” or “we” or “us”) respect your privacy and are committed to protecting it, as outlined in this policy (“Privacy Policy”).
This Privacy Policy explains what type of information we may collect from you when you access or use our online and/or mobile services, or otherwise interact with us (the “Services”), how we may use this information, who might have access to it, which choices you have about how it can be used and shared, and/or what measures Idealist takes to protect such information. If you follow a link to a third-party website, you are no longer covered by this Privacy Policy, and any data collection or processing activity that takes place on that website will be governed by that website’s own privacy policy.

1. SOURCES OF INFORMATION
The personal information we collect depends upon the Services you use. We may collect your personal information in the following ways:

The personal information we collect varies depending upon the nature of our Services. Where we collect sensitive personal information or special category data, we only do so where strictly relevant to the Services we provide, and we process this information in accordance with applicable law.

(b) Contact details, such as name, phone number, email address, and mailing address.

(h) Financial information, such as payment information needed to facilitate our fee-based Services that you may request. We rely on payment providers, such as Stripe, to process payments and we do not have access to payment card numbers.

How we use personal information depends on the nature of the Services you request. We may use the personal information that you give us to:

5. CHILDREN'S DATA
Our Services are not directed to children under 13 years of age and we do not knowingly collect personal information from children on our websites. Children under 13 years of age are prohibited from using our websites. Parental or guardian consent may be required to access our Services in certain circumstances.
6. RETENTION
We will keep your personal information for as long as we have an ongoing legitimate business need to do so. This includes providing you with Services you have requested from us or to comply with applicable legal requirements. It also includes keeping your personal information for so long as there is any possibility that you or we may wish to bring a legal claim, or where we are required to keep your personal information for legal or regulatory reasons. You also have the right to know what information, if any, Idealist discloses to third parties and the identities of those third parties.
- Right to Correction. You may have the right to request that we correct your personal information where it is inaccurate or out of date.
- Right to Deletion. You have the right under certain circumstances to have your personal information erased. Your information can only be erased if your data is no longer necessary for the purpose for which it was collected, and we have no other legal ground for processing the data.
- Right to Opt Out of Marketing. Where your personal information is processed for direct marketing purposes, you shall have the right to opt out at any time to processing of personal information for these purposes. We will provide specific information on how to opt-out from our marketing initiatives through the medium we communicate with you.
- Right to Restrict Processing. You may have the right under certain circumstances to request the restriction of your personal information from further use, e.g., where the accuracy of the information is disputed, and you request that the information not be used until its accuracy is confirmed.
- Right to Data Portability. You have the right under certain circumstances to data portability, which requires us to provide personal information to you or another controller in a commonly used, machine readable format, but only where the processing of that information is based on (i) consent; or (ii) the performance of a contract to which you are a party.

There may be situations where we cannot grant your request. For example, if you make a request and we cannot verify your identity, we will not be able to comply with the request. We may also be unable to comply with your request if we have a legal or regulatory obligation to retain your personal information, such as when the information is necessary to complete a transaction. Other reasons your request may be denied are if the request jeopardizes the privacy of others or would be extremely impractical to honor. We will not discriminate against you and will not restrict or deny you access to our Services because of choices and requests you make in connection with your personal information. EU, UK, and Swiss Transfers to the United States
Idealist participates in the EU-US Data Privacy Framework (“DPF”), the UK Extension to the DPF, and the Swiss-US DPF regarding the collection, use, and retention of personal information from European Union (“EU”) and European Economic Area (“EEA”) member countries, the United Kingdom (“UK”) and Switzerland. We have certified our adherence to DPF Principles with the US Department of Commerce.
As described in the “How We Disclose Your Information” section above, Idealist may disclose your personal information with third parties that perform services on our behalf. Idealist is responsible for ensuring that such third parties access, use, or otherwise process your personal information in compliance with the EU-US DPF, UK Extension to the DPF, and the Swiss-US DPF. Idealist will be liable for any third party’s failure to comply with the EU-US DPF, UK Extension to the DPF, and the Swiss-US DPF unless we prove we are not responsible for the event giving rise to the damage.
Idealist does not permit the use of your personal information for reasons that are materially different from those for which it was originally provided. We will update this Privacy Policy and provide you with notice and/or the ability to opt-out or opt-in (as applicable) prior to the release of your information.
Subject to applicable law, you have the right to access, correct, and delete your personal information. You also have the ability to limit the use and disclosure of your personal information. Please see the “Your Rights” section above for information about your privacy rights and choices.
Idealist’s compliance with the EU-US DPF, UK Extension to the EU-US DPF, and Swiss-US DPF is subject to the investigatory and enforcement powers of the US Federal Trade Commission. We may be required to disclose personal information that we handle under the EU-US DPF, UK Extension to the EU-US DPF, and the Swiss-US DPF in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Idealist is committed to referring unresolved DPF Principles-related complaints to a US-based, independent, dispute resolution provider, JAMS. You may visit https://www.jamsadr.com/DPF-Dispute-Resolution for more information about the dispute resolution process or to file a complaint if you do not receive timely acknowledgment of your complaint or your complaint is not satisfactorily addressed. JAMS provides these dispute resolution services at no cost to you. If neither Idealist nor JAMS resolves your complaint, you may, in certain circumstances, pursue binding arbitration through the DPF Panel.

Idealist’s Services and advertisements may use cookies and other technologies such as web beacons. We use this information to better understand, customize, and improve user experience with our websites, services and offerings. This information can make your use of our Services easier and more meaningful by allowing Idealist and our service providers to provide better service, customize sites based on consumer preferences, compile statistics, analyze trends and otherwise administer and improve our products and services. We may change this Privacy Policy from time to time. The “Last Updated” legend at the bottom of this Privacy Policy indicates when this Privacy Policy was last revised. Any changes will become effective when we post the revised Privacy Policy on the Services.
