INTRODUCTION

Actions Without Borders, Inc., and its affiliates (“Idealist” or “we” or “us”) respect your privacy and are committed to protecting it, as outlined in this policy (“Privacy Policy”). 

This Privacy Policy explains what type of information we may collect from you when you access or use our online and/or mobile services, or otherwise interact with us (the “Services”), how we may use this information, who might have access to it, which choices you have about how it can be used and shared, and/or what measures Idealist takes to protect such information. If you follow a link to a third-party website, you are no longer covered by this Privacy Policy, and any data collection or processing activity that takes place on that website will be governed by that website’s own privacy policy.

Please read this Privacy Policy carefully to understand our procedures and practices regarding your information and how we will treat it.

1. SOURCES OF INFORMATION

The personal information we collect depends upon the Services you use. We may collect your personal information in the following ways:

a) Directly from you. We collect personal information directly from you when you create an account with us, submit an application using our Services, visit our website(s) and/or application(s), apply for a position with us, contact us with a complaint or inquiry, or otherwise engage with us.

b) Automatically. In some instances, we may automatically collect certain types of information about you and your device when you visit our websites or exchange emails with us. Automated technologies may include the use of web server logs to collect IP addresses, "cookies" and web beacons. Further information about our use of cookies can be found in our Cookie Policy.

c) From third parties. When we provide the Services to employers, organizations, and other third parties, we may collect personal information about you, such as your name, contact details, date of birth, work history, and other resume details. We may also collect data from public sources including, but not limited to, social media and other websites that enable social sharing, from government agencies, public or third-party information sources, third-party service providers, or business partners.

2. INFORMATION WE COLLECT ABOUT YOU

The personal information we collect varies depending upon the nature of our Services. Where we collect sensitive personal information or special category data, we only do so where strictly relevant to the Services we provide, and we process this information in accordance with applicable law.

The personal information we collect about you may include the following:

(a) Account information, including username and password, permissions, and account actions.

(b) Contact details, such as name, phone number, email address, and mailing address.

(c) Demographic details, such as date of birth, age, gender, and marital status.

(d) Resume details, including educational history, skills, previous employment details, job title, salary, and other background detail.

(e) Immigration status, such as citizenship, work authorization, and visa information, if applicable.

(f) Communications data and other interactions, such as information you provide when you communicate with us via a complaint or inquiry.

(g) Internet activity, such as your IP address, browser and search history, device information, and information about your visits to our website.

(h) Financial information, such as payment information needed to facilitate our fee-based Services that you may request. We rely on payment providers, such as Stripe, to process payments and we do not have access to payment card numbers.

(i) Inferences drawn from any of the personal information described above to create a profile about an individual’s preferences, behavior, characteristics, and attitudes.

3. HOW WE USE PERSONAL INFORMATION

How we use personal information depends on the nature of the Services you request. We may use the personal information that you give us to:

  • provide Services for you and for our employer clients, such as processing your applications, sharing your application with employers, and facilitating transactions;
  • communicate with you, including to respond to your questions or inquiries by email or otherwise;
  • identify areas of interest to you;
  • provide you with notices about your account, including expiration and renewal notices;
  • with your consent, send you marketing communications to highlight opportunities that may be of interest to you; 
  • comply with legal obligations including to conduct certain screening procedures, to defend ourselves in litigation and investigations, and to prosecute litigations;
  • notify you about changes to our Services or any other products or services we may offer or provide though it;
  • allow you to participate in interactive and offline features of our Services;
  • allow you to connect with other users on our Sites, Mobile Apps, or other services;
  • consider potential improvements to our Services; and
  • provide a forum to connect people and organizations, such as yourself.

We may use personal information collected from any of the sources listed above for our internal business purposes, such as data analysis, audits, developing new products, enhancing our Services, identifying usage trends and determining the effectiveness of our promotional campaigns. We may also use inferences drawn from personal information to create a profile reflecting your preferences.

We may aggregate, anonymize and/or de-identify data we collect about customers and site visitors and use it for any purpose, including product and service development and improvement activities.

4. HOW WE DISCLOSE YOUR INFORMATION

We generally disclose your personal information with the following categories of recipients where necessary to offer, administer, and manage the Services provided to you.

  • At your direction, such as with organizations or employers to whom you apply to for employment, internships, or other experiences.
  • Vetting and risk management agencies, such as credit reference, criminal record, and other professional advisory agencies.
  • Legal advisers, where necessary to investigate, exercise, or defend legal claims.
  • Service providers, where we outsource operations to suppliers that process personal information on our behalf.
  • In connection with a merger, acquisition, or business transfer, where Idealist or our Services are sold to, acquired by, or merged with another organization and personal information needs to be shared with relevant third parties as part of due diligence processes.

At Idealist’s discretion, it may also disclose aggregated, anonymized or de-identified information that is not personally identifiable to third parties.

5. CHILDREN'S DATA

Our Services are not directed to children under 13 years of age and we do not knowingly collect personal information from children on our websites. Children under 13 years of age are prohibited from using our websites. Parental or guardian consent may be required to access our Services in certain circumstances.

6. RETENTION

We will keep your personal information for as long as we have an ongoing legitimate business need to do so. This includes providing you with Services you have requested from us or to comply with applicable legal requirements. It also includes keeping your personal information for so long as there is any possibility that you or we may wish to bring a legal claim, or where we are required to keep your personal information for legal or regulatory reasons. We may also retain your personal information where such retention is necessary to protect your vital interests or the vital interests of another natural person.

7. YOUR RIGHTS

Subject to certain exemptions and the jurisdiction in which you reside, you may have certain rights in relation to your personal information. If you exercise these rights, we may need to ask you for additional information to confirm your identity before fulfilling your request.

Subject to legal and other permissible considerations, we will make every reasonable effort to honor your request or inform you if we require additional information. Below is a list of some of the rights that may be applicable to you.

  • Right to know and access. You have the right to access or the right to know under certain circumstances the personal information which Idealist processes about you. You also have the right to know what information, if any, Idealist discloses to third parties and the identities of those third parties.
  •  Right to Correction. You may have the right to request that we correct your personal information where it is inaccurate or out of date.
  •  Right to Deletion. You have the right under certain circumstances to have your personal information erased. Your information can only be erased if your data is no longer necessary for the purpose for which it was collected, and we have no other legal ground for processing the data.
  • Right to Opt Out of Marketing. Where your personal information is processed for direct marketing purposes, you shall have the right to opt out at any time to processing of personal information for these purposes. We will provide specific information on how to opt-out from our marketing initiatives through the medium we communicate with you.
  • Right to Restrict Processing. You may have the right under certain circumstances to request the restriction of your personal information from further use, e.g., where the accuracy of the information is disputed, and you request that the information not be used until its accuracy is confirmed.
  • Right to Data Portability. You have the right under certain circumstances to data portability, which requires us to provide personal information to you or another controller in a commonly used, machine readable format, but only where the processing of that information is based on (i) consent; or (ii) the performance of a contract to which you are a party.
  • Right to Object to Processing. You have the right to object to the processing of your personal information at any time, but only where that processing is based our legitimate interests as its legal basis. If you raise an objection, we have an opportunity to demonstrate that we have compelling legitimate interests which override your rights and freedoms.

To help protect the security of your personal information, Idealist will verify your identity in connection with any requests. We take steps to ensure that only you or your authorized representative can exercise rights with respect to your information. If you are an authorized agent making a request, we may require and request additional information to protect the personal information entrusted to us, including information to verify that you are authorized to make that request.

There may be situations where we cannot grant your request. For example, if you make a request and we cannot verify your identity, we will not be able to comply with the request. We may also be unable to comply with your request if we have a legal or regulatory obligation to retain your personal information, such as when the information is necessary to complete a transaction. Other reasons your request may be denied are if the request jeopardizes the privacy of others or would be extremely impractical to honor. You may appeal a negative decision with us or directly with the appropriate authority in the jurisdiction where you live (e.g., with the Supervisory Authority if you reside in an EU Member State. We will not discriminate against you and will not restrict or deny you access to our Services because of choices and requests you make in connection with your personal information. Please note, certain choices may affect our ability to deliver our Services. For example, if you sign up to receive marketing communications by email, then ask us to delete all of your information, we will be unable to send you marketing communications.

EU, UK, and Swiss Transfers to the United States

Idealist participates in the EU-US Data Privacy Framework (“DPF”), the UK Extension to the DPF, and the Swiss-US DPF regarding the collection, use, and retention of personal information from European Union (“EU”) and European Economic Area (“EEA”) member countries, the United Kingdom (“UK”) and Switzerland. We have certified our adherence to DPF Principles with the US Department of Commerce. 

As described in the “How We Disclose Your Information” section above, Idealist may disclose your personal information with third parties that perform services on our behalf. Idealist is responsible for ensuring that such third parties access, use, or otherwise process your personal information in compliance with the EU-US DPF, UK Extension to the DPF, and the Swiss-US DPF. Idealist will be liable for any third party’s failure to comply with the EU-US DPF, UK Extension to the DPF, and the Swiss-US DPF unless we prove we are not responsible for the event giving rise to the damage.

Idealist does not permit the use of your personal information for reasons that are materially different from those for which it was originally provided. We will update this Privacy Policy and provide you with notice and/or the ability to opt-out or opt-in (as applicable) prior to the release of your information.

Subject to applicable law, you have the right to access, correct, and delete your personal information. You also have the ability to limit the use and disclosure of your personal information. Please see the “Your Rights” section above for information about your privacy rights and choices.

Idealist’s compliance with the EU-US DPF, UK Extension to the EU-US DPF, and Swiss-US DPF is subject to the investigatory and enforcement powers of the US Federal Trade Commission. We may be required to disclose personal information that we handle under the EU-US DPF, UK Extension to the EU-US DPF, and the Swiss-US DPF in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

If you have questions or complaints about how Idealist handles your personal information under the EU-US DPF, UK extension to the EU-US DPF, or the Swiss-US DPF, or about our privacy practices generally, please contact us at privacy@idealist.org. We will respond to your inquiry promptly. 

Idealist is committed to referring unresolved DPF Principles-related complaints to a US-based, independent, dispute resolution provider, JAMS. You may visit https://www.jamsadr.com/DPF-Dispute-Resolution for more information about the dispute resolution process or to file a complaint if you do not receive timely acknowledgment of your complaint or your complaint is not satisfactorily addressed. JAMS provides these dispute resolution services at no cost to you. If neither Idealist nor JAMS resolves your complaint, you may, in certain circumstances, pursue binding arbitration through the DPF Panel.

8. COOKIES

Idealist’s Services and advertisements may use cookies and other technologies such as web beacons. We use this information to better understand, customize, and improve user experience with our websites, services and offerings. This information can make your use of our Services easier and more meaningful by allowing Idealist and our service providers to provide better service, customize sites based on consumer preferences, compile statistics, analyze trends and otherwise administer and improve our products and services. 9. THIRD-PARTY LINKS

We may provide links within our websites or applications to other websites that may be of interest. We do not endorse the content of these sites or guarantee that they will abide by this Privacy Policy. Your use of such linked sites is subject to the terms of use and privacy policies of the providers of those sites. We encourage our users to read the terms of use and privacy policies of each site that collects your personal information.

10. DATA SECURITY & HOW WE PROTECT INFORMATION

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Please note, however, that despite the implementation of the above security policies, Idealist cannot guarantee that these security measures will prevent other third parties from unauthorized and unlawful access, use, alteration, and disclosure of your personal information. As such, any transmission of your personal information to us is at your own risk.

11. CHANGES TO THIS POLICY

We may change this Privacy Policy from time to time. The “Last Updated” legend at the bottom of this Privacy Policy indicates when this Privacy Policy was last revised. Any changes will become effective when we post the revised Privacy Policy on the Services.
