    Description

    The Good Health Project is hiring an attorney as counsel. The Good Health Project’s attorneys work directly with healthcare clients by providing counsel and advice in order to preserve and expand transgender healthcare services.

    This work entails detailed application of a broad range of legal and regulatory frameworks to the day-to-day clinical practices of our clients. Attacks by opponents of transgender healthcare are invoking many long-standing healthcare and consumer protection laws to produce novel arguments in support of their ideological positions. Our work anticipates and counters these arguments through deeply nuanced understanding of law, policy, legislative procedures, administrative procedures, and transgender healthcare.

    Examples of our work include, but are not limited to, clinic workflow audits, regulatory risk assessment, facility security and investigation readiness, privacy and confidentiality of PHI, new practice and practice expansion considerations, mental health practice issues, interstate clinical practice considerations, and contingency planning. We also assist our clients to advocate with regulators and elected officials regarding ways to improve access to care. Our representation of clients will often be undertaken jointly with co-counsel with relevant subject matter expertise, and/or with local counsel. The primary work products will be client memos and different varieties of letters in support of our clients. Although the Good Health Project’s principal aim is advising its clients in avoiding litigation, participation in litigation may be a possibility, but it is not part of our practice model at this time. The counsel will work primarily under the direct supervision of the senior counsel, and alongside our other counsel, our paralegal, and our director.

    The Good Health Project team also works together to establish the policies and workplace culture of the Good Health Project. Because this is a new practice, there is some flexibility for you to define your responsibilities in a way that best serves your unique talents and our clients’ and our team’s needs.

    What are the requirements?

    • Law license in any US jurisdiction
    • At least one year of practice experience
    • Excellent legal research and analysis skills, and the ability to communicate about nuanced topics in easily understood language, in both written format (client memos; know-your-rights memos) and verbally (conference presentations; webinars, etc.)
    • Although no specific area of practice experience or familiarity with an area of law is required, the more experience with any or all of the following that an applicant has, the more competitive their application will be: state and federal consumer protection laws; state healthcare regulations; relevant state employment and civil rights laws; medical malpractice; federal health insurance programs; private medical insurance; state and federal investigation and enforcement proceedings; False Claims Act; Food, Drug & Cosmetics Act; HIPAA

    What are the compensation and other conditions?

    This role is ideal for an earlier-career lateral attorney (1-7 years of prior experience). Counsel salaries are on a sliding scale based on experience, up to $125,000 for 7 years of experience, and starting at $89,000 at 1 year.

    Work is currently remote; although hybrid may be a possibility in some locations as we grow. Schedules are flexible and set by mutual agreement, with at least four hours required between 10:00 a.m. and 6:00 p.m. Eastern time every weekday. The Good Health Project offers unlimited paid leave time and is closed on federal holidays.

    The Good Health Project covers licensure expenses, and provides each employee with professional development funds.
